Description

An industrial design is the ornamental or aesthetic aspect of an article. The design may consist of three-dimensional features, such as the shape, configuration or surface of an article, or of two dimensional features, such as patterns, lines or colour.

Design law in Pakistan is governed under 2 legislations:

Procedure:

  1. Ensure the design is new or original, not previously published, and relates to the shape, configuration, pattern, or ornamentation of an article. Functional or mechanical features are not protected. A prior search at IPO-Pakistan is recommended.
  2. Submit the prescribed form along with clear representations (drawings/photos), statement of novelty, and required fee. A power of attorney is needed if filing through an agent.
  3. IPO examines the application for formal compliance, novelty/originality, and whether the design is against public order or morality. Any objections must be resolved within the specified time.
  4. If approved, the design is registered, entered into the Register of Designs, published in the official journal, and a certificate of registration is issued.
  5. Protection is granted for 10 years from filing, renewable for another 10 years (maximum 20 years). The registered owner gets exclusive rights to use the design and can take legal action against infringement
